Should he be held responsible? Ipod broken. ?

My clmate couldn't take a joke, or he doesn't know his own strength. I said something about his hair jokingly and he caught me off guard when he came from my side and shoved me almost knocking me off balance. My two day old 4th gen iPod touch, in my hoodie pocket as it always is, flies out and lands face first, cracking much of the bottom left of the gl. It still functions. Now, he initially said to my face right after that he would pay for it, but I tried to talk to him on facebook and he (presumably) blocked me. I wasn't able to see him today. So if he opts out of paying for a new screen, is he still responsible for the damage? What should I say?
